New Zealand Internships โ Terms and Conditions
These Terms and Conditions constitute the agreement between the Candidate and New Zealand Internships, operating under Intern Limited (referred to as “NZI”). By submitting an application for an internship and/or upon acceptance into an internship program, the Candidate confirms that they have read, understood, and agreed to these Terms and Conditions.
1. Definitions
1.1 Candidate: A natural person who applies for an internship through NZI.
1.2 Candidate Profile: A brief description (including name, address, education, experience, etc.) of the Candidate, completed via an electronic profile form on NZIโs website.
1.3 Contact Information: The name, address, phone number, email, and other contact details of both the Candidate and the Host Organisation.
1.4 CV: The Candidateโs curriculum vitae, either filled out on NZIโs website or attached to the Candidate Profile.
1.5 Host Organisation: A person or entity seeking an intern or work experience participant within its organisation or that of its constituent.
1.6 Internship: A voluntary work experience with a Host Organisation. This relationship is not one of employment.
1.7 Personal Information: Data that identifies or can identify the Candidate.
1.8 Website: NZIโs website (www.internships.co.nz) and/or partner sites.
2. Application Process
2.1 Eligibility: Candidates must be between 18 and 30 years old and must secure a valid visa for the duration of the internship. The Candidate is responsible for obtaining the correct visa.
2.2 Educational Institution: If applicable, the Candidate is responsible for obtaining permission from their educational institution to undertake the internship.
2.3 Access to Platform: Upon signing up, the Candidate will receive login details for the NZI Candidate Platform.
2.4 Payment of Fees: The Candidate must pay the deposit (NZD $250) including a non-refundable administration fee (NZD $75) before accessing NZIโs services.
2.5 Profile Submission: After payment, the Candidate is required to submit a complete Candidate Profile, including an up-to-date CV, a professional photograph, and a cover letter. The Candidate agrees to have their completed Profile and photo shared with third parties and on the NZI’s websites.
2.6 Internship Search: NZI will commence the search for an internship upon submission of the Candidate Profile. NZI will inform the Candidate as soon as a potential opportunity is identified.
2.7 Interview Arrangement: If an internship opportunity is found, NZI will generally arrange an interview between the Candidate and the Host Organisation. The Candidate will be informed promptly of any internship offers.
2.8 Placement Acceptance: The Candidate may accept or decline an internship offer. If declining, a valid reason must be provided. Declining an offer because the Candidate found an internship independently is not a valid reason.
2.9 Placement Fee: Upon sign-up for our program, the Candidate will receive a personalised quote for the placement fee.
2.10 Contractual Relationship: Once the internship agreement is signed, it supersedes all prior agreements. These Terms and Conditions remain applicable unless otherwise stated.
2.11 Completion of Services: When the Candidate signs the internship agreement with the Host Organisation, the contract supersedes all prior agreements.ย These Terms and Conditions will continue to apply unless otherwise stated in any other agreement signed by the parties.
2.12 End or relationhip: Once the internship agreement has been signed by NZI, the Host Organisation and the Candidate, the contractual relationship between NZI and the parties involved will come to an end, unless for aspects expressly stated in the agreement or in these Terms and Conditions.
2.13 Declining: NZI reserves, at all times, the right to decline Candidates who are deemed unsuitable for an internship.ย NZI cannot guarantee an internship for every Candidate and cannot be held accountable for any reason if an internship is unable to be secured.
2.14 Personal information: The Candidate agrees that their personal information will be shared with third parties in order to provide the requested services.
2.15 Amendments: The information given by Candidates might be altered by NZI slightly.ย The Candidate is permitted to access their information and to make amendments. These amendments are only permitted when it is in the interest of fulfilling the service.
3. Payment
3.1 Deposit and Fee: By signing up, the Candidate agrees to pay the deposit and non-refundable administration fee of 75 NZD.
3.2 Refund Conditions: If NZI cannot secure an internship, the deposit will be refunded under the circumstances outlined in Section 4.
3.3 Placement Fee: If the Candidate accepts a placement offer by signing the internship agreement, they must pay the remainder of the full placement fee.
3.4 Payment Deadline: The full placement fee must be paid within 10 days of the invoice or prior the start date of the internship.
3.5 Late Payment: If payment is not received within 10 days, NZI will send a reminder. If no response is received within 5 days, an NZD $50 administration fee may be charged. If the fee remains unpaid, NZI reserves the right to terminate the internship.
3.6 Legal Costs: The Candidate is liable for any legal and related costs incurred by NZI in recovering amounts owed due to a breach of these terms.
3.7 Price Quotes: Any price quotes communicated by NZI are at their absolute discretion and can be subject to change. While NZI endeavours to the best of their abilities to prevent mis-quotes for reasons of typing accuracy, such errors cannot be honoured.
4. Refund Policy
4.1 Refund Eligibility: If NZI is unable to secure an internship for the Candidate, the deposit will be refunded, minus a NZD $75 administration fee.
(a) It is the Candidate’s responsibility to notify NZI if they wish to sign out.
(b) The Candidate may only sign out and request a refund after a minimum of 4 weeks from the date their profile is submitted to NZI.
4.2 Non-Refundable Circumstances: The deposit will not be refunded if the Candidate:
- Fails to complete their Profile within 3 weeks of NZIโs request.
- Withdraws from the application process without a legitimate reason.
- Finds an internship or work experience position themselves while they knew NZI was still working on their internship placement.
- Does not respond to emails, thereby affecting the search process.
- Declines an offer matching their requirements.
- Provides false or misleading information.
- Has failed to provide evidence from their educational institution that an internship NZI has arranged meets the educational institutionโs requirements.
- Discloses information or engages in conduct during the application process that warrants them unsuitable or undesirable, such as requesting payment for an internship during an interview, declining an internship because it is unpaid or disclosing that there are restrictions on an internship location.
- is actively in contact with a potential host company regarding a possible placement or has been invited to attend an interview, any decision to withdraw from the process by the candidate at this stage will be considered a change of mind. In such cases, the deposit paid will be non-refundable, as resources have already been allocated to facilitating the placement process.
4.3 Consideration for Refund: NZI may consider refunds in cases of bereavement, illness, or similar circumstances.
4.4 Unsuccessful Placement: If a placement is unsuccessful due to NZIโs actions, the Candidate may be entitled to a partial or full refund of program fees.
4.5 Bank Charges: The Candidate is responsible for their own bank charges in relation to the processing of the deposit and/or full placement fees. In the event of NZI being charged such fees, the Candidate will be invoiced for any such bank fees after the charges are incurred by NZI.
5. Unpaid Internship
The candidate agrees to accept an unpaid internship and be a volunteer within the Host Organisation.
If in the unlikely event, a payment is provided by the Host Organisation to the Candidate this will be an arrangement solely between them and does not involve NZI.
6. NZI Support Services
6.1 Visa Information: NZI directs Candidates to Immigration New Zealandโs website for visa information. NZI is not responsible for the visa application process.
6.2 Housing: NZI may assist with housing arrangements, but is not responsible for providing alternative accommodations if the Candidate is unsatisfied.
7. Activities
7.1 Social Activities: Candidates may participate in NZI-organised social activities.
7.2 Payment for Activities: Candidates must pay for activities within 7 days of signing up.
7.3 Activity Cancellation by Candidate: If a Candidate cancels an activity more than two weeks before it is scheduled, they are entitled to a refund minus a NZD $50 administration fee. If cancelled within two weeks, the refund is minus 25% (minimum NZD $50). If cancelled less than a week before, the refund is minus 50% (minimum NZD $50).
7.4 Activity Cancellation by NZI: If NZI cancels an activity, Candidates will receive a full refund.
7.5 Alternative Activities: If an activity during a weekend trip is cancelled, NZI will arrange an alternative. A refund will be provided if the alternative is cheaper.
7.6 No-Show: If a Candidate does not show up or arrives late, NZI will continue without them, and no refund will be issued.
8. Responsibility and Disclaimer
8.1 Damages: Any party that breaches these Terms is liable for direct and indirect damages, including legal costs.
8.2 Legal Rights: NZI reserves the right to take legal action, including contract dissolution.
8.3 NZIโs Liability: NZI is not liable for any damages or losses resulting from:
(a)ย ย incurred by the Host Organisation as a result of the placement of the Candidate and/or if Candidate does not act in accordance with the contract made with the Host Organisation.
(b)ย ย incurred by the Host Organisation or a third party as a result of a Candidate who does not have the required diploma or other proof of competence.
(c)ย ย as a result of an incorrect selection of a Candidate by the Host Organisation, or otherwise as a result of an incorrect selection of an internship by the Candidate.
(d)ย ย as a result of the unavailability or disturbance of the website or the facilities of an internet provider and/or telecommunication provider.
(e)ย as a result of a computer hack or Cyber Attack.
8.4 Replacement Internship: NZI is not liable or responsible for arranging a replacement internship for the Candidate if the Candidate does not fulfill their tasks sufficiently or if a Candidate does not keep adhering to the contract.
9. Personal Information
9.1ย ย ย The used and provided personal information of a Candidate is confidential and will at all times be the responsibility of NZI.
9.2ย ย Personal information will only be used by NZI to achieve the aim for which it was provided by a Candidate.
9.3ย ย Personal information will be kept in perpetuity in NZIโs Database for the purpose of recordkeeping, however, this information will at all times be protected and is only accessible to authorised persons. NZI trains both authorised persons and representatives how to correctly and carefully use personal information.
10. Intellectual Property Rights
All author rights, brand rights, business rights and all other intellectual property rights based on software, the website, the services of NZI, the information on the website (excluding possible author rights on the content of a Candidateโs Profile, vacancies, logos, brands and other information on the website, for which the Host Organisation gives NZI non-exclusive user rights) are only given by NZI and/or its licence.
11. Confidentiality
11.1ย ย All Candidates agree to keep confidential all information relating to Host Organisations they have interviewed with and/or interned with.
11.2ย All Candidates agree to keep confidential all information owned by, o in the possession of NZI, that is not in the public domain and which NZI reasonably regards as private.
11.3ย This confidentiality requirement applies at all times during the application process and/or during an internship and/or after the internship has ended.
12. Legally Binding Electronic Agreements
All parties agree that electronically established agreements and communications are legally binding.
13. Severability
If at least one of the Clauses in these Terms and Conditions is deemed to be invalid or unlawful, the other Clauses will keep their validity. The Clause(s) that are not valid or applicable will be replaced by Clause(s) that are similar and valid.
14. Length of the Agreement and Adjustments
14.1ย ย Agreements with NZI are valid for an undetermined period, unless the agreement specifically states differently. Cancellation is possible by both a Candidate and NZI, subject, to the definitions stated in any agreement between both parties.
14.2ย ย NZI has the right to change these Terms and Conditions at any time. Any changes made will be posted on the website in the form of an updated Terms and Candidate. Candidates will not be individually notified of any changes. We recommend Candidates read the Terms and Conditions monthly.ย If a Candidate does not agree with any change, they have the right to inform NZI (by email or post) within 30 days after the change.
15.ย Governing Law
15.1ย ย Agreements with NZI are managed and controlled by the law of New Zealand.
15.2ย ย If a conflict appears with NZI regarding the use and services outlined on the website, the parties will try to solve the problem personally before contacting a third party. If the parties do not solve the problem personally, the conflict will be forwarded to an independent mediation group.
